Terms of Service

1. Who these terms are with

These terms are an agreement between you and Tim Veles, Haus 26, Technologie- und Gewerbepark Eberswalde, Alfred-Nobel-Straße 1, 16225 Eberswalde, Germany ("Without.", "we"), a private individual. By creating an account you accept them. During the closed test the Beta Test Agreement applies in addition and takes precedence wherever the two differ.

2. You must be 18

Without. is strictly for adults. You confirm you are 18 or older, that you are legally able to enter this agreement, and that you are not barred from using the service under any applicable law, and have never been convicted of a felony, a sex offence, or any crime of violence. We terminate accounts that breach this without notice or refund. We check age at sign-up and remove the account of anyone under 18 as soon as we learn of it.

3. Your account

• One account per person. Accounts are personal and cannot be sold or transferred.
• Give accurate information - a real first name and a real age. Misrepresenting your age or identity is grounds for removal.
• Keep your sign-in secure. Two-factor authentication is free and we recommend it.
• You are responsible for what happens on your account.

4. What you may not do

• Harass, threaten, stalk, defame or abuse anyone.
• Impersonate anyone, or pretend to be an age or person you're not.
• Solicit money, investments, crypto, gifts or "help" from other members. This is the single most common form of harm on dating services and we act on it aggressively.
• Advertise, recruit, promote, or use the service commercially, including sex work.
• Post or send content that is unlawful, hateful, sexually explicit, or that sexualises minors in any way.
• Share anyone else's private information, screenshots, messages or voice notes.
• Scrape, copy, reverse-engineer or automate access to the service, or attempt to circumvent our anti-copying, link-blocking or screenshot protections.
• Send links. They are blocked; attempting to evade the block is a breach.
• Use bots, fake accounts or automation of any kind.

5. Your content stays yours

You own everything you write and record. To run the service you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display your content solely to operate and improve Without. - that is, to show your profile to other members and deliver your messages. This licence ends when you delete the content or your account, except for copies we must keep for safety or legal reasons, and copies other members legitimately hold of conversations with you.

We will never use your words in marketing without asking you first.

6. Photos and voice

Without. is a text-first service. Photos are never shown before you match, have a genuine exchange, and both choose to reveal. Voice notes work the same way - both people must opt in. Content shared with another member cannot be un-seen; consider that before you reveal anything.

7. Safety and moderation

We use automated moderation and human review, and we act on reports. We may remove content, restrict features, suspend or permanently ban an account where we reasonably believe these terms or our Community Guidelines have been broken - with notice where practical, and immediately where there is risk of harm. Serious matters are referred to law enforcement.

Meeting people is your responsibility. We don't run criminal background checks. Verification confirms a live human, not a good one. Meet in public, tell a friend where you're going, and leave if something's off.

8. Free and paid

• The core service - reading, liking, chatting, voice notes, mutual reveal - is free.
• Premium is sold as a fixed term - one month or three months - and three months is the longest term we offer. Prices are shown before purchase in your local currency and may vary by market and over time.
• Premium does not auto-renew. When your term ends, your account simply returns to the free tier - we do not silently charge you again. We may remind you that your term is ending, but continuing is always an active choice you make.
• If a term ends and you'd like to continue, you can buy another. If you have completed a three-month term and are not seeing results, we invite you to contact [email protected] first: a person will review your profile and suggest improvements before you decide whether to buy again. This is a courtesy, not a guarantee of any outcome.
• You can cancel an active term at any time via your app store or account settings; access continues until the end of the paid period. Uninstalling the app does not cancel or refund a purchase.
• Purchases made through Apple or Google are governed by their refund policies; we cannot refund those directly.
• EU/UK right of withdrawal: you have 14 days to withdraw from a digital purchase. By starting Premium immediately you ask us to begin performance; once fully performed the right ends. Unused, unstarted purchases are refundable within 14 days.
• Virtual items (Super Likes, Boosts) are a licence to use a feature, not property. They have no cash value and expire with your account.

9. Ending it

You may delete your account at any time in Settings - it is permanent. We may suspend or end your access for a breach of these terms, for a legal requirement, or if we discontinue the service. If we end your account for reasons other than your breach, we will refund the unused portion of a paid period. If we end it for a breach, we will not.

10. Service "as is"

We work hard to keep Without. running and accurate, but we provide it as is. We do not promise matches, replies, dates, or that anyone you meet is who they claim. To the fullest extent permitted by law we disclaim implied warranties. Nothing here limits liability for death, personal injury caused by negligence, or fraud.

11. Liability

To the fullest extent permitted by law, our total liability to you is limited to the greater of the amount you paid us in the 12 months before the claim, or EUR 100. We are not liable for indirect or consequential loss, or for the conduct of other members - online or in person. Consumer rights that cannot be waived remain unaffected.

12. Changes

We may update these terms. Material changes will be notified in the app at least 30 days in advance where the law requires. Continuing to use Without. after they take effect means you accept them; if you don't, delete your account.

13. Law and disputes

These terms are governed by the laws of Germany, without regard to conflict-of-law rules. If you are a consumer in the EU/UK you keep the protection of the mandatory laws of your country of residence and may bring proceedings there. We are not obliged, and do not intend, to participate in dispute resolution before a consumer arbitration board (Verbraucherschlichtungsstelle).
